Ombudsman ipinasisibak si House Deputy Speaker Rep. Gwendolyn Garcia

IPINASISIBAK ng Office of the Ombudsman si House Deputy Speaker at Cebu 3rd district Rep. Gwendolyn Garcia kaugnay ng kasong grave misconduct.

Ayon kay Ombudsman Conchita Carpio-Morales, ito ay nag-ugat sa pagbili umano ni Garcia ng kontrobersyal na 249,000-square meter Balili property sa Naga, Cebu noong 2008 na nagkakahalaga ng halos P100-milyon, kung saan ang ilang bahagi nito ay parte ng mangrove area.

Batay sa ulat, taong 2012 nang magkaroon ng public bidding at igawad sa Supreme ABF Construction ang kontrata ng supply at delivery ng backfilling materials dahil sa murang bid nito na P248.75 per cubic meter, at tumanggap ng bayad na P24,468,927.66.

Pero ayon kay Ombudsman Morales, walang otoridad si Garcia na noo’y Cebu governor mula sa mga miyembro ng Sangguniang PanlalawIgan (SP) ng igawad ang bayad sa nasabing kompanya.

“While this Office finds merit on her assertion that the P50million allotment for the airport/seaport and other economic enterprise site development program (a capital outlay expenditure that was carried over to the 2012 Annual Budget of the province), was a valid source of appropriation for the Balili project, such appropriation did not validly confer authority to respondent Garcia to enter into a contract with ABF Construction for the Balili project,” giit ni Morales sa desisyong pinirmahan nitong Enero 15.

Dagdag pa nito na nilabag din daw ni Garcia ang section 46 at 47 ng Chapter 8, Book V ng 1987 Administrative Code, at section 6 ng Government Auditing Code of the Philippines.

“It is undisputed that the (certification of available funds) was issued only after the (second) contract was entered into by respondent Garcia.”

Sa ngayon ay nagbigay na si Morales ng kopya ng desisyon kay House Speaker Pantaleon Alvarez para sa magiging aksyon nito.

Bukod sa mambabatas, ay kinasuhan naman ng simple neglect of duty ang co-respondent na si Emmanuel Guial, provincial accountant, na kumumpirmang kumpleto ang mga dokumentong kailangan, sa kabila ng wala pang basbas ng SP.

Haharap si Guial sa tatlong buwang suspensyon, samantalang mga kasong administratibo naman ang mga opisyal at miyembro ng Bids and Awards Committee na sina chairperson Marivic Garces, vice-chairperson Bernard Calderon; mga miyembrong sina Manuel Purog, Emme Gingoyon, Ma. Junelene Arenas, Cristina Giango, Rosalinda Jao; at acting provincial treasurer Roy Salubre dahil sa lack of merit.
